These General Terms and Conditions apply to every offer from the trader and to every distance contract concluded between the trader and the consumer.
The text of these Terms and Conditions will be made available to the consumer before a distance contract is concluded. If this is not reasonably possible, the trader will indicate how the Terms and Conditions can be viewed electronically or will send them free of charge upon request.
If the contract is concluded electronically, these Terms and Conditions may also be supplied in a format that allows the consumer to store them on a durable medium.
In cases where specific product or service conditions apply, the provisions of these Terms and Conditions remain valid, and in case of conflicting provisions, the consumer may rely on the more favourable option.
If any provision in these Terms and Conditions is null or void, the rest remains valid. An invalid provision will be replaced with one that matches the original intent as closely as possible.
Situations not governed by these Terms will be interpreted in accordance with the spirit of these Terms.
Article 4 – The Offer
If an offer has limited validity or specific conditions, this will be clearly stated.
Offers may be modified by the trader.
The offer includes a complete and accurate description of the products/services. Product images are faithful representations, but colour variations may occur. Obvious errors do not bind the trader.
The offer includes sufficient information about:
-
The price, excluding import duties and VAT (collected by postal or courier service);
-
Shipping costs, if applicable;
-
Method of contract conclusion;
-
Whether the right of withdrawal applies;
-
Payment, delivery, and performance terms;
-
The validity of the offer;
-
Communication costs (if different from standard);
-
Whether the contract will be archived;
-
How errors can be corrected before finalising the contract;
-
Available languages;
-
Codes of conduct the trader observes;
-
The contract duration for recurring transactions.
Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and meets the specified conditions.
If the consumer accepts electronically, the trader will confirm receipt of acceptance. Until this confirmation is received, the consumer may cancel the contract.
The trader ensures secure electronic data transmission. If applicable, secure payment methods will also be used.
The trader may verify the consumer’s ability to fulfil payment obligations. If there are valid grounds for refusal, the trader may decline the order or apply special conditions.
Upon delivery or service provision, the trader will supply:
-
The address for complaints;
-
The withdrawal procedure or confirmation of its exclusion;
-
Warranty and after-sales service details;
-
The information referred to in Article 4(3);
-
Conditions for cancelling extended or indefinite contracts.
Article 6 – Right of Withdrawal
Consumers may cancel their contract within 30 days of receiving the goods, without giving reasons.
During this period, the consumer shall handle the product carefully and return it in original condition and packaging.
To exercise the right of withdrawal, the consumer must notify the trader in writing within 30 days. The consumer must then return the product within 30 days of notification, providing proof of return.
Article 7 – Withdrawal Costs
Consumers bear the cost of returning items.
If payment has been made, the trader will refund the consumer within 14 days of withdrawal, provided the item has been returned or return proof has been submitted.
Article 8 – Exclusion of Right of Withdrawal
The trader may exclude withdrawal rights for:
-
Custom or personalised items;
-
Perishable or hygienic goods (e.g. underwear);
-
Items damaged or used beyond assessment purposes;
-
Sealed media products with broken seals.
Article 9 – Pricing
Prices will not change during the offer validity unless due to VAT adjustments.
Price increases within three months are only allowed if legally required. Later increases must be agreed upon, with the consumer having the right to cancel.
Prices are exclusive of import VAT and duties, which are collected upon entry into the UK.
Typographical or obvious pricing errors are not binding.
Article 10 – Compliance and Warranty
The trader guarantees product conformity with the contract and description.
Consumers must report faults within 14 days of delivery. Items must be returned unused and in original packaging.
Warranty does not apply to items:
-
Altered or repaired by the consumer or third parties;
-
Misused or mishandled;
-
Affected by regulatory changes.
Article 11 – Delivery and Fulfilment
Orders are delivered to the address provided by the consumer.
Delivery takes place within 30 days, unless otherwise agreed. Delays entitle the consumer to cancel and claim a refund within 14 days.
Replacement items may be offered, clearly marked as such. Consumers maintain withdrawal rights. Return costs in such cases are covered by the trader.
Risk of loss or damage transfers upon delivery unless otherwise agreed.
Article 12 – Duration and Termination of Contracts
Termination:
Consumers may terminate rolling contracts at any time with no more than one month’s notice.
Fixed-term contracts may be terminated at the end of the term with up to one month’s notice.
Termination must be allowed in the same manner as contract conclusion.
Extension:
Contracts cannot be automatically extended, except:
-
Print subscriptions for up to 3 months (consumer may cancel with one month’s notice);
-
Indefinite renewal, provided the consumer can cancel at any time with appropriate notice.
Duration:
Contracts longer than one year may be cancelled after one year with no more than one month’s notice, unless early termination is unreasonable.
